The Delaware River Tubing Company and its famous hot dog stand in the middle of the river have resumed operations for the summer, despite an ongoing legal fight.
Greg Crance, known as the Hot Dog Man, owner of Delaware River Tubing, Inc. since 1987, said he reopened the food stand July 8, and resumed tubing operations during the first weekend of June.
However, the tubing company doesn’t currently have a concession agreement with the New Jersey Department of Environmental Protection.
The agreement, which the state declined to renew last July, is required for the company to drop off and pick up customers from the river’s edge because the land is within the Delaware & Raritan Canal State Park.
In March, the state announced it was accepting bids for a river tubing concession in the park.
Crance said the DEP has been “trying to work closely with us,” and they want to finalize a settlement that is reasonable and fair for both parties.
“We’re trying to make it very amicable and our concern is the safety for the customers and the public,” Crance said. “Also, (we’re) helping generate revenue for the state in tax and tourism dollars. We want to play a key role in that.”
Crance said he hopes a settlement is worked out within a week or so, which will include an agreement over the $43,000 the tubing company owes the state. Caryn Shinske, a spokeswoman for the DEP, said the department does not comment on active litigation matters.
According to Crance, the company has welcomed a large number of customers since operations resumed in June, including Rep. Tom Malinowski (D-7), who went for a ride with Crance on Thursday.
“We actually had Congressman Tom Malinowski out here looking at how great of an outdoor activity it is,” Crance said. “It’s perfect for social distancing. In these difficult times, it’s important people get out.”
Masks are required for check-in and shuttle rides, Crance said, and the shuttles are running at 50% capacity. Masks are not required while on the river.
Karen DeMarco, Hunterdon County’s health officer, said the Delaware River Tubing company “is in compliance with all required standards related to safe food handling.”
The county’s health department doesn’t inspect or license the tubing activity, since it doesn’t meet the definition of a recreational bathing facility under the law, she said.
